These “terms and conditions” and “mentions légales” are issued by S.A.R.L. Limited as (“the operator”) and form part of the contract between the operator and you, and govern the terms on which the operator offers holiday services.

No contract shall be formed between you and the operator until you have received confirmation that the operator has accepted your booking. The completion of a booking form or receipt of the confirmation documentation confirms acceptance of the operator’s terms and conditions. It is the responsibility of the person booking the holiday (“the group leader”) to ensure that all members of his/her party are aware of these terms and conditions.

“We”, “Us” or “Ours” means the Operator.

Cancellation By You

Deposit:

You can only cancel your holiday by sending us notice in writing by post. Your cancellation is only effective from the date we receive your written notification.

If you cancel, you will forfeit your deposit.

However, if we are able to re-let your holiday, we will refund a part of the holiday price up to the amount we obtain from the re-letting, less the transferring fee (varied) and the administration charge of €30.

Full reservation paid:

You can only cancel your holiday by sending us notice in writing by post. Your cancellation is only effective from the date we receive your written notification.

If you cancel, you will forfeit your deposit. Any cancellation made during the 8-week period where the full amount should be paid, you will forfeit your full payment.

However, if we are able to re-let your holiday, we will refund a part of the holiday price up to the amount we obtain from the re-letting, less the transferring fee (varied) and the administration charge of €30.

Rules

The Group Leader is responsible for ensuring that members of the party follow all safety regulations and other directions at the site. We reserve the right to refuse admission or to remove you from the site if you or any members of your party do not follow such safety regulations. In that situation, we will not have any further responsibility or liability. We shall not be liable for any costs, loss, or damage, and no refunds will be made.

All Inclusive Anglers: You will be asked to pay a security deposit of €100 per person on arrival at the venue. All persons are responsible for any damage done or loss sustained to any facilities and fishing package at the site during the stay.

Drive and Survive Anglers: You will be asked to pay a security deposit of €50 per person on arrival at the venue. All persons are responsible for any damage done or loss sustained to any facilities and fishing package at the site during the stay.

If, in the reasonable opinion of the Manager of the site, you or any member of your party is unsuitable to remain at the site because of suspected or actual influence of drugs or alcohol, or because of irresponsible behaviour likely to cause danger to themselves, other persons, fish, or property, then you and/or members of your party can be removed from the site. In that situation, neither the Manager nor we will have any further responsibility or liability. We shall not be liable for any costs, loss, or damage, and no refunds will be made.

Travel

We only offer the services described in the brochure. It is your responsibility to ensure that you make appropriate travel arrangements.

It is no part of our contract to supply you with travel arrangements, nor can we accept any liability whatsoever in this regard.

Details

We take every reasonable precaution to ensure that all details in the brochure are accurate. There may, however, be small differences between the actual services offered and their description in the brochure. Occasionally, some facilities or services may become unavailable or subject to restriction. We cannot accept responsibility for any inaccurate, incomplete, or misleading information except in the case of negligence by us.

This Contract

This contract is governed by French law. We and you are agreed to submit any dispute to the exclusive jurisdiction of the Courts of France in Rodez

Liability

You must take all necessary steps to safeguard your personal safety. We accept no liability for any death or personal injury unless this results from the negligence by us or our employees (provided they were at the time acting in a course of their employment).

We will not be responsible for any injury, illness, death, loss, damage expense, cost, car damage or other sum or claim of any description whatsoever which result from any of the following:

(a) the fault of either you or a member of your party; or

(b) the fault of any third party; or

(c) an event or circumstances which we could not have predicted or avoided even after taking all reasonable care; or

(d) the fault of anyone not carrying out any work for us.

the maximum amount we may have to pay you for any and all claims or part of claims which do not involve personal injury, illness or death is limited. The maximum amount we will found liable to you on any basis, is twice the price of the holiday. (Excluding amendment charges) This maximum amount will only be payable when you have not received any benefit at all from your holiday.

Payment

You will pay a non-refundable deposit of €150 per fisherman when you book your holiday.

The balance of your payment is due to be paid 8 weeks before arrival.

In the event that you do not make a payment in full by the due date of your holiday, it will be cancelled and the cancellation charges will apply.

We reserve the right to increase or decrease the total holiday price by no more than 5% without notice before full payment of your booking is made.

Amendments

If you wish to amend details of your holiday, we will try to accommodate you in the booking year only. We are, however, not bound to accept any amendment. Any request for amendment should be made in writing, and any amendments to your holiday will attract a non-refundable administration charge of €30 per person. No amendment can be made for the following seasons.

Occasionally, we have to make changes to the holidays. We therefore reserve the right to amend your holiday. Except where you have failed to make payment, we will offer you the choice of a full refund of all money paid to us or the purchase of an alternative holiday (if available), with you paying or receiving a refund in respect of any price difference.

In all cases, our liability is limited to either a refund of the price or the offer of an alternative holiday (where available), and we cannot meet any costs or expenses you incur as a result of any cancellation or change. No compensation is payable, and no liability offered other than a refund of the money you have paid or an alternative holiday. Claims for compensation for loss of enjoyment or other expenses not arranged with us, including travelling expenses or travel tickets, are specifically excluded.

Minor changes do not entitle you to cancel or change to another holiday without paying our normal charges.

Force Majeure

We cannot accept liability, and no compensation will be payable where the performance or prompt performance of our contract with you is prevented or affected by “force majeure”. In these terms, “force majeure” means any event that we or any other supplier of the services in question could not, even with due care, have foreseen or avoided. This may include war, threat of war, riot, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, and all similar events outside our control.

People Aged Under 18

The Group Leader must be over the age of 18. It is the Group Leader’s responsibility to ensure the safety of any member of the party under the age of 18.

A Fishing Holiday Participation Disclaimer Under 18s will have to be signed on arrival.

Insurance

It is your responsibility to ensure that you have adequate travel and personal insurance to cover all instances of personal injury, loss, and/or damage to property and/or medical expenses. The booking of a holiday is confirmation by the Group Leader, to us, on behalf of the group, that appropriate insurance is in place.

It is your responsibility to read your policy details carefully and take them with you on holiday. It is your responsibility to ensure the cover you purchase is adequate for your particular needs.

Passport/Visa/Vaccination

It is recommended that you and each and every member of the party possess a valid passport and visa (if applicable). It is your responsibility to ensure that you have any applicable vaccinations before you travel. If you fail to obtain any relevant documentation or vaccinations before your travel, you are solely responsible for any costs, loss, or damage which you incur as a result of that failure. We shall not be liable for any costs, loss, or damage, and no refunds will be made.

Data Protection Policy

You consent to our use of any personal details provided to us for our own internal administrative purposes and for future marketing. If you provide us with fax, phone, or email details, you authorise us to contact you using that method. If you decide that you no longer wish us to communicate with you, or the details we hold for you change, or you decide to register with the telephone preference service or the fax preference service in the UK or any equivalent, you agree to tell us to enable us to update our records.

We will hold your information and may use it to inform you of offers in the future or to send you brochures. Again, if you do not want to receive this information in the future, please write to us.

We will not provide your details to any third parties for marketing purposes.

Complaints And Claims

If you have a complaint whilst you are on a holiday, please inform the Manager immediately so that remedial action, where possible, can be taken.

If your complaint cannot be resolved then please contact us on telephone no. +33 05 65 63 23 18 as soon as possible and we will endeavour to help you.

If you remain dissatisfied and wish to make a claim against us then you must right to us within 3 days of your return home giving full details and your booking references number.

For all complaints and claims which do not involve personal injury, illness or death we cannot accept any liability if you fail to notify any complaints or claim within 3 days of your return home as we have been deprived of the opportunity to investigate and if appropriate rectify the problem.

 

Notices

Any notices due to be served under these terms and conditions will be sent by us to the address given on your booking form. you must write to us at:

It is important that all our guests respect this environment, including the lake inhabitants.

  • A refundable deposit of €50 (Drive & Survive) or €100 (All Inclusive) must be paid upon arrival. The deposit is only refundable if all fishing equipment is returned in full working order as received.
  • All 14 double swims must be reserved for 2 anglers.
  • No braided mainline. Minimum main line BS of 15lbs and hook links 25lbs.
  • Lead core is forbidden on this lake.
  • Micro barbed hooks only, up to size 2. Bent hooks (long shank curved hooks) are not allowed.
  • Only safe rigs utilising a proper lead discharge system, such as safety bolt beads, allowed. 
  • Life jackets must be worn at all times when you are operating a boat.
  • Drive and Survive anglers must have very good carp care safety kits (unhooking mat, sacks, weigh sling, landing nets). Kits can be provided. See bailiff for details.
  • Unhooking mats must be used at all times. Do not take fish out of the water until you have all the equipment ready (unhooking mat, sacks, weigh sling).
  • We have to prioritise some of our bigger fish. We will let you know which ones. These fish must not leave the water until one of the bailiffs has arrived;
  • Please treat fish with respect, keep handling to a minimum when weighing and photographing your catch and return fish to the water as quickly as possible.
  •  
  • All anglers must have Medi-Carp with them in the event of a fish being injured. Medi-Carp is available to purchase from The Lodge.
  • Do not sack the Grass Carp at any time. As we all know, Grass Carp are not the strongest of the carp family and are prone to stress very quickly. This is for the welfare of the fish.
  • Only our particles and mixes can be used here. Available at The Lodge for a minimum cost (please let us know 24 hours in advance).
  • All plastic and artificial baits are forbidden.
  • Please return unused bait to The Lodge on your departure. Do not throw it in the lake or on the bank.
  • Barbecues are not allowed.
  • Stalking is allowed, but no pre-baiting. 
  • Pike fishing is only allowed during the pike season but you can fish different species of fish, please ask the bailiffs.
  • You must keep your swim clean at all times. You will find plenty of bins provided. For community and ecological reasons, you must sort your rubbish (batteries, glass, metal, other rubbish etc). 
  • Defecating around the lake will not be tolerated. Those found fouling their swim will be asked to leave and will not be able to return in the future. 
  • Drive and Survive anglers use the car park at your own risk. 
  • Each angler enters the lake for the purpose of fishing completely at their own risk.

Life Jackets

For your safety, please ensure that you choose the correct size of life jacket for your weight. If there is no appropriate life jacket available, then you are not, under any circumstances permitted to use the boats.

Please make sure that you are absolutely clear of these rules which are designed to ensure your safety.

Upon arrival at the lake, we will demonstrate the correct fitting of the life jackets. It’s important that you clearly understand how to correctly fit the life jacket, and that you never enter a boat unless your life jacket is correctly fitted. If you have any queries, then please ask us to ensure that you have absolute clarity on how to safety wear the life jackets provided.

We understand that some anglers may not wish to enjoy the boating experience so, when you arrive at the venue, please make this clear to the manager and this will be taken into account.

Boats are only to be used for baiting up, putting rods out or for landing fish on all swims, accessible by pathways. Boats are not to be used for rowing around the lake, or back to the lodge. Swimming is completely forbidden. Life jackets must be worn at all times when out in the boat. Any angler found breaking any of the above rules will be banned from using a boat for the remainder of their visit.

We are not liable for any form of transportation of your goods to and from swims.

Any anglers who have been caught or seen breaking any of the above rules and has been banned from using a boat, be found using the boat again, will be immediately be requested to leave the venue.

Anglers wishing to use the boats at Cavagnac Lake do so entirely at their own risk. With the understanding that the S.A.R.L cannot be held liable in the event of any accident and no refunds will be made. It is compulsory that each angler have their own personal travel insurance.

Cars and Trailers

Please note that we are not responsible for any car damage or loss. The owners park their cars at their own risk as stated on the notice boards in the parking areas.

  • I declare that I will not attend the fishing holiday at Cavagnac Lake unless I am medically fit on the day, and that I participate at my own risk.

  • To the extent permitted by law, I accept that A.R.L. Lac de Cavagnac will not be liable for any loss, damage, action, claim, costs, or expenses arising from my participation in the fishing holiday.

  • Nothing in these terms shall exclude or limit the liability of A.R.L. Lac de Cavagnac for death or personal injury caused by its negligence or fraud.

  • I grant permission to A.R.L. Lac de Cavagnac to use, or authorize third parties to use, photographs, videos, recordings, or any other data relating to my participation for legitimate purposes, without remuneration.

  • I hereby agree to indemnify S.A.R.L. Lac de Cavagnac against all claims, losses, and expenses arising from any breach of these conditions, unauthorized acts, or otherwise.
  • Any breach of these conditions or failure to follow lawful instructions from staff or bailiffs may result in termination of my participation.

  • I will behave in a manner acceptable to A.R.L. Lac de Cavagnac, other participants, the venue, and any persons affected by my actions.

  • I will cooperate with all requests made by staff or venue personnel involved in the fishing holiday.

Dogs are welcome under these conditions.

  • No more than one dog per swim.
  • No dog known as potentially dangerous.
  • No dog around the lodge area for the whole time and on the swims: 16, 17 and 18  (shallows, lodge and stalk).  
  • Never leave your dog unattended.
  • Dog is to be kept on lead and on the swim for the whole week.
  • Watch your dog at all times. Discourage him barking and digging. If your dog digs a hole, fill it in.
  • Your dog must wear a collar or harness at the lake and be attached the whole time.
  • Owners must clean up after their dog. All dog feces must be picked up and put in disposal stations.
  • No dogs in heat, aggressive, or sick.
  • You are responsible for any injury, any damage and any problems caused by your dog.
  • Dogs must be licensed and vaccinated.
  • If your dog causes any of the above problems you will be asked to leave the lake.

If you want to prevent yourself against any refusal

Dogs will only be allowed under these conditions. Please respect them. Any rule broken will not be tolerated for the wellbeing of all of us.

If, in the reasonable opinion of the Manager of the site, you or any member of your party is unsuitable to remain at the site because of suspected or actual influence of drugs or alcohol, or because of irresponsible behaviour likely to cause danger to themselves, other persons, fish, or property, then you and/or members of your party can be removed from the site. In that situation, neither the Manager nor we will have any further responsibility or liability. We shall not be liable for any costs, loss, or damage, and no refunds will be made.

Force Majeure

We cannot accept liability, and no compensation will be payable where the performance or prompt performance of our contract with you is prevented or affected by “force majeure”. In these terms, “force majeure” means any event that we or any other supplier of the services in question could not, even with due care, have foreseen or avoided. This may include war, threat of war, riot, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, and all similar events outside our control.

People Aged Under 18

The Group Leader must be over the age of 18. It is the Group Leader’s responsibility to ensure the safety of any member of the party under the age of 18.

A Fishing Holiday Participation Disclaimer Under 18s will have to be signed on arrival.

Insurance

It is your responsibility to ensure that you have adequate travel and personal insurance to cover all instances of personal injury, loss, and/or damage to property and/or medical expenses. The booking of a holiday is confirmation by the Group Leader, to us, on behalf of the group, that appropriate insurance is in place.

It is your responsibility to read your policy details carefully and take them with you on holiday. It is your responsibility to ensure the cover you purchase is adequate for your particular needs.

Travel

We only offer the services described in the brochure. It is your responsibility to ensure that you make appropriate travel arrangements.

It is no part of our contract to supply you with travel arrangements, nor can we accept any liability whatsoever in this regard.

Passport/Visa/Vaccination

It is recommended that you and each and every member of the party possess a valid passport and visa (if applicable). It is your responsibility to ensure that you have any applicable vaccinations before you travel. If you fail to obtain any relevant documentation or vaccinations before your travel, you are solely responsible for any costs, loss, or damage which you incur as a result of that failure. We shall not be liable for any costs, loss, or damage, and no refunds will be made.

Data Protection Policy

You consent to our use of any personal details provided to us for our own internal administrative purposes and for future marketing. If you provide us with fax, phone, or email details, you authorise us to contact you using that method. If you decide that you no longer wish us to communicate with you, or the details we hold for you change, or you decide to register with the telephone preference service or the fax preference service in the UK or any equivalent, you agree to tell us to enable us to update our records.

We will hold your information and may use it to inform you of offers in the future or to send you brochures. Again, if you do not want to receive this information in the future, please write to us.

We will not provide your details to any third parties for marketing purposes.

Details

We take every reasonable precaution to ensure that all details in the brochure are accurate. There may, however, be small differences between the actual services offered and their description in the brochure. Occasionally, some facilities or services may become unavailable or subject to restriction. We cannot accept responsibility for any inaccurate, incomplete, or misleading information except in the case of negligence by us.

This Contract

This contract is governed by French law. We and you are agreed to submit any dispute to the exclusive jurisdiction of the Courts of France in Rodez

Complaints And Claims

If you have a complaint whilst you are on a holiday, please inform the Manager immediately so that remedial action, where possible, can be taken.

If your complaint cannot be resolved then please contact us on telephone no. +33 05 65 63 23 18 as soon as possible and we will endeavour to help you.

If you remain dissatisfied and wish to make a claim against us then you must right to us within 3 days of your return home giving full details and your booking references number.

For all complaints and claims which do not involve personal injury, illness or death we cannot accept any liability if you fail to notify any complaints or claim within 3 days of your return home as we have been deprived of the opportunity to investigate and if appropriate rectify the problem.

Liability

You must take all necessary steps to safeguard your personal safety. We accept no liability for any death or personal injury unless this results from the negligence by us or our employees (provided they were at the time acting in a course of their employment).

We will not be responsible for any injury, illness, death, loss, damage expense, cost, car damage or other sum or claim of any description whatsoever which result from any of the following:

(a) the fault of either you or a member of your party; or

(b) the fault of any third party; or

(c) an event or circumstances which we could not have predicted or avoided even after taking all reasonable care; or

(d) the fault of anyone not carrying out any work for us.

the maximum amount we may have to pay you for any and all claims or part of claims which do not involve personal injury, illness or death is limited. The maximum amount we will found liable to you on any basis, is twice the price of the holiday. (Excluding amendment charges) This maximum amount will only be payable when you have not received any benefit at all from your holiday.

It is important that all our guests respect this environment, including the lake inhabitants.

  • A refundable deposit of €50 (Drive & Survive) or €100 (All Inclusive) must be paid upon arrival. The deposit is only refundable if all fishing equipment is returned in full working order as received.
  • All 14 double swims must be reserved for 2 anglers.
  • No braided mainline. Minimum main line BS of 15lbs and hook links 25lbs.
  • Lead core is forbidden on this lake.
  • Micro barbed hooks only, up to size 2. Bent hooks (long shank curved hooks) are not allowed.
  • Only safe rigs utilising a proper lead discharge system, such as safety bolt beads, allowed. 
  • Life jackets must be worn at all times when you are operating a boat.
  • Drive and Survive anglers must have very good carp care safety kits (unhooking mat, sacks, weigh sling, landing nets). Kits can be provided. See bailiff for details.
  • Unhooking mats must be used at all times. Do not take fish out of the water until you have all the equipment ready (unhooking mat, sacks, weigh sling).
  • We have to prioritise some of our bigger fish. We will let you know which ones. These fish must not leave the water until one of the bailiffs has arrived;
  • Please treat fish with respect, keep handling to a minimum when weighing and photographing your catch and return fish to the water as quickly as possible.
  •  
  • All anglers must have Medi-Carp with them in the event of a fish being injured. Medi-Carp is available to purchase from The Lodge.
  • Do not sack the Grass Carp at any time. As we all know, Grass Carp are not the strongest of the carp family and are prone to stress very quickly. This is for the welfare of the fish.
  • Only our particles and mixes can be used here. Available at The Lodge for a minimum cost (please let us know 24 hours in advance).
  • All plastic and artificial baits are forbidden.
  • Please return unused bait to The Lodge on your departure. Do not throw it in the lake or on the bank.
  • Barbecues are not allowed.
  • Stalking is allowed, but no pre-baiting. 
  • Pike fishing is only allowed during the pike season but you can fish different species of fish, please ask the bailiffs.
  • You must keep your swim clean at all times. You will find plenty of bins provided. For community and ecological reasons, you must sort your rubbish (batteries, glass, metal, other rubbish etc). 
  • Defecating around the lake will not be tolerated. Those found fouling their swim will be asked to leave and will not be able to return in the future. 
  • Drive and Survive anglers use the car park at your own risk. 
  • Each angler enters the lake for the purpose of fishing completely at their own risk.

Life Jackets

For your safety, please ensure that you choose the correct size of life jacket for your weight. If there is no appropriate life jacket available, then you are not, under any circumstances permitted to use the boats.

Please make sure that you are absolutely clear of these rules which are designed to ensure your safety.

Upon arrival at the lake, we will demonstrate the correct fitting of the life jackets. It’s important that you clearly understand how to correctly fit the life jacket, and that you never enter a boat unless your life jacket is correctly fitted. If you have any queries, then please ask us to ensure that you have absolute clarity on how to safety wear the life jackets provided.

We understand that some anglers may not wish to enjoy the boating experience so, when you arrive at the venue, please make this clear to the manager and this will be taken into account.

Boats are only to be used for baiting up, putting rods out or for landing fish on all swims, accessible by pathways. Boats are not to be used for rowing around the lake, or back to the lodge. Swimming is completely forbidden. Life jackets must be worn at all times when out in the boat. Any angler found breaking any of the above rules will be banned from using a boat for the remainder of their visit.

We are not liable for any form of transportation of your goods to and from swims.

Any anglers who have been caught or seen breaking any of the above rules and has been banned from using a boat, be found using the boat again, will be immediately be requested to leave the venue.

Anglers wishing to use the boats at Cavagnac Lake do so entirely at their own risk. With the understanding that the S.A.R.L cannot be held liable in the event of any accident and no refunds will be made. It is compulsory that each angler have their own personal travel insurance.

Cars and Trailers

Please note that we are not responsible for any car damage or loss. The owners park their cars at their own risk as stated on the notice boards in the parking areas.

Dogs are welcome under these conditions.

  • No more than one dog per swim.
  • No dog known as potentially dangerous.
  • No dog around the lodge area for the whole time and on the swims: 16, 17 and 18  (shallows, lodge and stalk).  
  • Never leave your dog unattended.
  • Dog is to be kept on lead and on the swim for the whole week.
  • Watch your dog at all times. Discourage him barking and digging. If your dog digs a hole, fill it in.
  • Your dog must wear a collar or harness at the lake and be attached the whole time.
  • Owners must clean up after their dog. All dog feces must be picked up and put in disposal stations.
  • No dogs in heat, aggressive, or sick.
  • You are responsible for any injury, any damage and any problems caused by your dog.
  • Dogs must be licensed and vaccinated.
  • If your dog causes any of the above problems you will be asked to leave the lake.

If you want to prevent yourself against any refusal

Dogs will only be allowed under these conditions. Please respect them. Any rule broken will not be tolerated for the wellbeing of all of us.

Brisky - Single Swim

Its depth varies from 3 to 9 feet with hard floor all the way along the two margins and a silty ground in the middle. It’s a one man swim located not far from the entrance of the lake. It’s cut off from the other swims and is generally where carp pass seeking the quietest part of the lake. Lily pads on each side and opposite along the margins maximize your chance of catching fish.
